By booking this Short-Term Rental (STR) reservation, the Guest acknowledges and agrees to the terms of this Waiver and Release of Liability (“Agreement”). This Agreement is intended to be STR-friendly and enforceable as a digital acceptance under Florida law.

This Waiver and Release of Liability (“Waiver”) is entered into by the renter(s) and guests (collectively, “Renter”) in favor of the property owner, manager, agents, and representatives (collectively, “Owner”).
- Acknowledgment of Risk
Renter acknowledges that the Property includes access to a natural body of water, which may present inherent and non‑obvious risks, including but not limited to:
- Drowning or near drowning
- Slippery or uneven surfaces
- Sudden drop‑offs, submerged objects, rocks, logs, vegetation, or debris
- Florida Wildlife (including snakes, insects, fish, alligators, or other animals)
- Water quality issues, algae, or limited visibility
- Weather‑related hazards
- Lack of lifeguards, supervision, or safety equipment
Renter understands that these risks may result in serious injury, permanent disability, or death.
- Voluntary Use
Renter understands and agrees that:
- No lifeguard or water safety personnel are provided.
- Swimming is not allowed at the lake.
- Renter agrees to exercise reasonable judgment and caution.
- Renter is solely responsible for always supervising all minors and guests.
- Release and Waiver of Liability
To the fullest extent permitted by law, Renter releases, waives, discharges, and holds harmless Owner from any and all claims, demands, causes of action, damages, losses, costs, or expenses arising out of or related to use of the lake or natural body of water resulting in injuries, death, or property damage, whether caused by negligence or otherwise.
- Assumption of Responsibility for Guests
Renter acknowledges that this Waiver applies to all occupants, invitees, and guests, whether or not they have signed this Waiver individually. Renter accepts full responsibility for informing guests of the risks and ensuring compliance with safety rules.
- Indemnification
Renter agrees to indemnify and defend Owner against any claims, liabilities, or expenses arising from Renter’s or Renter’s guests’ use of the lake.
- Governing Law and Severability
This Waiver shall be governed by and interpreted in accordance with the laws of the State of Florida. If any provision of this Waiver is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
- Digital Acknowledgment and Acceptance
By completing an Airbnb reservation for this Property the Guest certifies that:
- Guest has read and fully understands this Agreement.
- Guest agrees to all terms and conditions of this agreement.
- Guest accepts responsibility for all occupants associated with the reservation.
This electronic acceptance shall have the same force and effect as a handwritten signature under Florida law. This Agreement is supplemental to Airbnb’s Terms of Service and does not replace or limit any protections, responsibilities, or obligations imposed by Airbnb policies.
